1. Acceptance of Terms

Welcome to Chairvex. These Terms of Service ("Terms") govern your access to and use of the Chairvex online store located at chairvex.myshopify.com (the "Site"), including all content, functionality, products, and services offered on or through the Site. By accessing, browsing, or making a purchase from the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.

These Terms constitute a legally binding agreement between you ("you," "your," or "Customer") and Chairvex ("we," "us," "our," or "Store"). We reserve the right to update, modify, or replace any part of these Terms at any time. Your continued use of the Site following the posting of changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.

2. Eligibility

By using the Site and our services, you represent and warrant that you are at least the age of majority in your state or territory of residence (18 years of age in most U.S. jurisdictions), or that you are the age of majority in your jurisdiction and have given us your consent to allow any of your minor dependents to use the Site under your supervision and responsibility. You may not use our products or services for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

3. The Store and Products

Chairvex offers a curated selection of furniture and home furnishing products for sale through the Site. We strive to display our products as accurately as possible, including product descriptions, specifications, dimensions, materials, colors, features, images, and availability. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. Product colors and appearances may vary slightly due to photographic lighting sources, screen settings, and monitor resolution. Certain weights, measurements, and capacities are approximate.

We reserve the right at any time to modify, discontinue, update, or remove products or product listings, whether temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product or service.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Site will be corrected. All product descriptions, specifications, and availability information are subject to change without notice.

4. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the product(s) in your cart subject to these Terms. All orders are subject to acceptance by Chairvex. We reserve the right, in our sole discretion, to refuse or cancel any order for any reason, including but not limited to product or service availability, errors in product or pricing information, errors in your order, suspected fraudulent or unauthorized transactions, or problems identified by our credit or fraud avoidance departments. We may also require additional verifications or information before accepting any order.

You will receive an order confirmation email after placing your order, which confirms that we have received your order. Please note that this confirmation does not constitute our acceptance of your order—it is simply a confirmation of receipt. A contract between you and Chairvex will not be formed until we have processed your payment and dispatched your order. We reserve the right to cancel your order at any time prior to dispatch, even after you receive an order confirmation.

If we cancel an order after payment has been processed, we will refund the full amount paid within a reasonable timeframe. If your order is canceled, if there was an error in pricing, or if we are unable to fulfill your order for any reason, you will be notified by email and will not be charged.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was placed.

5. Pricing and Sales Tax

All prices displayed on the Site are in United States Dollars (USD) and are exclusive of applicable sales tax. Prices are subject to change at any time without notice, although changes will not affect orders for which we have already sent you an order confirmation (subject to our order acceptance and cancellation rights above).

We strive to provide accurate pricing information, but pricing or typographical errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for an order that is subsequently canceled due to a pricing error, we will issue a credit to your credit card account in the amount of the incorrect price.

Sales Tax: Applicable state and local sales taxes will be calculated and added to your order total at checkout based on the shipping destination address. The amount of sales tax charged depends on various factors including the products purchased, the destination state and locality, and applicable tax laws. As a Customer, you are responsible for any sales, use, excise, value-added, or other taxes or duties imposed by any jurisdiction in connection with your purchase, other than taxes based on our net income.

We collect and remit sales tax in accordance with applicable federal and state laws. If you believe you are exempt from sales tax, you must contact us prior to placing your order with appropriate tax exemption documentation for review.

6. Payment

Payment is due at the time you place your order. We accept major credit cards, debit cards, and other payment methods as indicated on the Site at checkout. By submitting your payment information, you authorize us (or our third-party payment processor) to charge the applicable amount to your selected payment method. You represent and warrant that: (i) you have the legal right to use any payment method(s) you submit; (ii) the information you supply to us is true, correct, and complete; and (iii) charges incurred by you will be honored by your payment method provider.

We use third-party payment processors to process payments made to the Site. Your payment information is encrypted and processed securely in accordance with payment card industry standards. We do not store complete credit card information on our servers. By providing your payment information, you agree to the terms and privacy policies of our third-party payment processor(s).

In the event of payment failure, fraud detection, declined authorization, or chargeback, we reserve the right to suspend or terminate your access to the Site, cancel your order(s), and pursue any available legal remedies. You agree to pay all costs and fees (including reasonable attorneys' fees) incurred by us in collecting amounts due from you.

7. Shipping and Delivery

We currently ship to addresses within the United States. Shipping within the United States is FREE—there are no shipping costs for domestic orders. Orders are generally processed within approximately 1 to 2 business days following successful payment confirmation. Estimated delivery time is typically 3 to 5 business days from the date of shipment to eligible United States destinations.

Delivery times are estimates only and are not guaranteed. Actual delivery times may vary due to carrier delays, weather conditions, holidays, transportation interruptions, customs (if applicable), incorrect or incomplete shipping information, or other circumstances beyond our reasonable control. Chairvex is not responsible or liable for any delays in shipping or delivery.

You are responsible for providing a complete and accurate shipping address. We are not responsible for orders delivered to incorrect addresses provided by the Customer. If a package is returned to us due to an incorrect address, refused delivery, or failure to claim the package, you may be responsible for additional shipping charges to reship the order.

Title and risk of loss for all products pass to you upon delivery to the carrier. Once your order has been dispatched, you will receive a shipping confirmation email with tracking information, where available. Please allow carriers adequate time to update tracking information.

8. Returns and Refunds

Chairvex offers a 30-day return policy as a matter of our own store policy. Please note that there is no statutory "cooling-off period" or automatic right of withdrawal for online purchases under U.S. federal law; our 30-day return window is a voluntary policy provided to our customers.

Eligible products may be returned within 30 days after delivery, subject to the conditions and procedures set forth in our dedicated Returns and Refunds Policy. To qualify for a return, items must generally be unused, in original condition, and in original packaging with all tags and labels attached. Certain products may be non-returnable or subject to restocking fees as described in the Returns Policy.

To initiate a return, please contact us using the contact information provided in Section 15 below or follow the instructions on our Returns Policy page. We will provide you with a return authorization and instructions. You are responsible for return shipping costs unless the return is due to our error (e.g., defective, damaged, or incorrect item).

Refunds, when approved, will be issued to the original payment method within a reasonable timeframe after we receive and inspect the returned item(s). Please allow additional time for your financial institution to process the refund. Original shipping costs (if any) are generally non-refundable.

9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, design, layout, "look and feel," and the compilation and organization thereof (collectively, the "Content"), is the property of Chairvex or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Chairvex name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Chairvex or its affiliates or licensors. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content solely for your personal, non-commercial use and solely to purchase products for your own use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content, except as necessary to use the Site for its intended purpose (i.e., browsing and purchasing products). You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information without our express written consent.

Any unauthorized use of the Content or the Site may violate copyright, trademark, privacy, publicity, and other laws, and is strictly prohibited. Nothing in these Terms grants you any right, title, or interest in or to the Content or intellectual property, except for the limited license expressly set forth above. All rights not expressly granted are reserved by Chairvex.

10. Acceptable Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Chairvex, a Chairvex employee, another user, or any other person or entity.
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Chairvex or users of the Site or expose them to liability.
  • To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
  • To attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
  • To use any automated means, including robots, scrapers, or data mining tools, to access, monitor, or copy any content from the Site without our prior written permission.
  • To engage in any fraudulent activity, including using stolen credit cards, falsifying information, or misrepresenting your identity or affiliation.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities and terminating your access to the Site.

11. Disclaimers of Warranties

YOUR USE OF THE SITE, ITS CONTENT, AND ANY PRODUCTS PURCHASED THROUGH THE SITE IS AT YOUR SOLE RISK. THE SITE, ITS CONTENT, AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER CHAIRVEX NOR ANY PERSON ASSOCIATED WITH CHAIRVEX MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE OR PRODUCTS.

TO THE FULLEST EXTENT PROVIDED BY LAW, CHAIRVEX HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

CHAIRVEX DOES NOT WARRANT THAT: (A) THE SITE OR PRODUCTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SITE WILL BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.
